SME Table Talk: Grant of Probate vs Letters of Administration

When a person dies leaving assets in Malaysia, the deceased's next of kin (or family members) will have to apply for relevant grant of representation from the High Court in order to deal with the deceased's estate. The process of this application will depend on whether the deceased: -
  • Died leaving a valid Will (testacy);
  • Died without leaving a Will (intestacy); or
  • Died leaving a valid Will but it does not dispose off his/her entire estate (partial intestacy).
A proper estate administration help ensures that the rightful surviving beneficiaries inherit the assets of the deceased.
