SME Table Talk: Liability of a Guarantor under the Insolvency Act 1967

The guarantor of a loan is liable to pay the loan if the debtor fails to do so. In today's commercial world, a guarantor may be required in a variety of transactions ranging from home rental to appliance purchase, to financing applications.
More often than not, guarantors willingly sign the contract of guarantee without fully realising the impact it may have in the future.

So what if you are a guarantor for an educational loan, hire-purchase loan or housing loan for a friend or relative? Can the creditors come after you as the guarantor if the debtor fails to pay his/her loan? What protection does the law provide for guarantors, if any?

Find out more in this SME Table Talk where our Senior Associate - Mavin Jothy, sheds light on the liability of a guarantor under the Insolvency Act 1967.
